This document is presented to you in the App before your first participation in a session. It forms an integral part of adré’s Terms of Service and applies to every session you take part in through the App: coached sessions, group sessions, friend sessions, and solo sessions tracked in the App (Pulse).
It is restricted to people aged 18 or over. By accepting it, you confirm that you are of legal age.
I understand and acknowledge that physical activity involves inherent risks, including without limitation: muscle or joint injury, falls, fainting, cardiac events, accidents related to the environment (traffic, weather, terrain, equipment) and, in extreme cases, serious injury, permanent disability or death.
I voluntarily and knowingly assume those risks.
I declare that:
I understand that adré is a connecting platform: adré does not provide the sessions, does not employ coaches, does not organize sessions between users and does not supervise activities. Coaches remain solely responsible for their services. Sessions between users take place under the sole responsibility of the participants.
The data and content shown in the App (heart rate, calories, pace, challenges) is provided for information only and is neither medical advice nor a personalized training programme.
To the extent permitted by applicable law, I release adré, its officers, employees and partners from any claim, demand or action for damages arising out of my participation in a session or my sport activity tracked through the App, including claims based on bodily injury.
This release does not apply:
What this document does establish, whatever the applicable law, is my acknowledgment of the risks inherent in the activity and the voluntary nature of my participation (Sections 1 and 2), which stand regardless of the validity of this Section 4.
This release in no way limits the coaches’ or other participants’ own liability towards me.
This Section applies only to people residing in the State of New York (United States). It does not apply to any user residing in Switzerland, in the European Union, or in any other country — for those users, only Sections 1 to 4 apply.
Please read carefully. This section affects your legal rights.
I acknowledge that athletic and fitness activities — whether led by a coach, organized among users, or performed alone and tracked through the App — involve inherent risks, including muscle and joint injury, falls, fainting, cardiac events, environmental hazards (traffic, weather, terrain, equipment), and, in extreme cases, serious injury, permanent disability or death.
I voluntarily and expressly assume all risks inherent in these activities, including risks that are obvious, necessary, or reasonably foreseeable consequences of participating.
I represent that I have no known medical contraindication to physical activity, that I have consulted a physician if in any doubt, and that I select activities appropriate to my present condition.
I acknowledge that adré does not provide coaching services, does not employ or supervise coaches, does not own or operate any gym, pool, place of amusement or recreation, and does not organize sessions between users.
To the fullest extent permitted by New York law, I release and discharge adré, its officers, employees and agents from any claim or demand for damages arising out of my participation in a session or my athletic activity tracked through the App, including claims based on bodily injury caused by ordinary negligence.
This release does not apply, and is not intended to apply:
Section 5.1 (assumption of risk) applies independently of, and survives, any determination that this Section 5.2 is unenforceable in whole or in part.
This Section 5 is governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes are subject to Section 15 of the Terms of Service, which contains a binding individual arbitration clause, a class action waiver and a 30-day opt-out right.
Checking the acceptance box in the App, with the date, time and version number recorded, constitutes your electronic signature.
The accepted version remains available at any time on this page and from your account settings. adré keeps a timestamped history of versions and acceptances.
